GENERAL TERMS AND CONDITIONS
1. BASIC PROVISIONS
These General Terms and Conditions regulate the ordering, payment, delivery, and complaints of products offered in the web shop (link) owned by the Trade Craft KLARA, Obala dr. Ante Starčevića 29, Cavtat, OIB: 97145140010 (hereinafter: Seller), as a business relationship between the Seller and web shop visitors, i.e., product buyers (hereinafter: Buyer).
1.1. Definitions:
A Buyer is any adult and legally capable person who accepts these Terms and orders a product. It is considered that the sales contract is concluded at the moment the Seller sends order confirmation to the Buyer's email address.
A Visitor is any person who accesses the site without making a purchase. By registering or submitting an order, the Buyer confirms that they are familiar with these Terms and accept them in their entirety.
1.2. Authenticity of photographs and copyright
Product photographs are illustrative in nature. Due to manual production and different screen calibrations, minor deviations in color and details are possible, which is not considered a product defect.
The content on the site (logo, photographs, texts, and jewelry design) is protected by copyright. Any unauthorized use or copying of content is strictly prohibited.
1.3. Changes to the General Terms and Conditions
The Seller reserves the right to amend these General Terms and Conditions at any time, and the amendments become effective upon publication on this website.
1.4. Data Accuracy
The Buyer is responsible for the accuracy and completeness of the data entered during registration or ordering. The use of another person's personal data is not permitted."
2. CONCLUSION OF CONTRACT AND PRODUCTS
2.1. The sales contract is considered concluded at the moment the Seller confirms receipt of the order via email.
2.2. Product characteristics: All items are made of silver, gold-plated silver, or gold and are described in detail for each product.
2.3. Product photographs are illustrative; due to screen settings and manual production, minimal deviations in color or details are possible, which is not considered a defect.
2.4. Availability: In the event that the ordered product is currently out of stock, the Seller will inform the Buyer and offer a replacement product or a refund of the paid amount. In this case, the order is considered canceled without further obligations for the Seller.
3. ORDER, PRICES, AND PAYMENT
3.1. Order process: Purchases are made through the Web shop by filling out an electronic order form.
3.2. Prices: Stated in euros (€), include VAT, and are valid at the time of order. The Seller reserves the right to change prices, except for already confirmed orders.
3.3. Payment method: Exclusively via the Monri Payment Gateway system (accepted cards: Visa, Mastercard, Maestro, Diners).
3.4. Data security:
The confidentiality of your data is protected and secured using the latest version of TLS encryption. Online payment websites are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a process of encrypting data to prevent unauthorized access during its transmission.
This enables secure data transfer and prevents unauthorized data access during communication between the user and the Monri WebPay payment system and vice versa.
The Monri WebPay payment system and financial institutions exchange data through their virtual private network (VPN) which is also protected from unauthorized access.
Monri Payments is a PCI DSS Level 1 certified payment service provider, regulated by Visa and Mastercard rules.
Credit card numbers are not stored by the Merchant and are not accessible to unauthorized personnel.
4. DELIVERY, DEADLINES, AND RISKS
4.1. Territory: Product delivery is carried out through the GLS delivery service.
4.2. Delivery cost: For all orders with a value above €100.00, delivery is free. For orders with a value less than €10.00, the delivery cost is automatically calculated at the end of the purchase and is clearly visible to the Buyer before confirming the order.
4.3. International shipments: When delivering outside the borders of the European Union, all potential customs costs, import duties, and local taxes in the importing country are borne exclusively by the Buyer. The Seller has no influence on these costs or on the customs clearance procedure.
4.4. Deadlines: The Seller undertakes to process and hand over the order to the delivery service within 3 to 5 business days of visible payment. Delivery times depend on the service provider (GLS) and the recipient's address.
4.5. Transfer of risk: The risk of accidental damage and destruction of the product passes to the Buyer at the moment when the Buyer, or a person authorized by them to receive the shipment, takes possession of the product from the delivery service. We advise Buyers to visually inspect the package upon receipt and, in case of visible damage to the packaging, immediately file a complaint with the delivery person.
5. UNILATERAL TERMINATION OF CONTRACT AND PRODUCT RETURN
5.1. Right to terminate: The Buyer has the right, without stating reasons, to terminate the contract within 14 days of receiving the goods, provided that the product is completely unworn, undamaged, and in its original packaging.
5.2. Exceptions to the right of return: In accordance with Article 79 of the Consumer Protection Act, these apply to:
a) Personalized jewelry: Products made to customer specifications are not subject to return.
b) Earrings: Due to hygiene and health reasons, return of earrings is not possible if the security seal on the packaging has been removed or visibly damaged.
5.3. Return cost: The direct costs of returning the goods (postage and shipping costs) are entirely borne by the Buyer.
5.4. Refund: The refund of the paid amount will be made no later than 14 days from the date of receipt of the termination notice, provided that the Seller has previously received the returned goods and confirmed their correctness (unworn and undamaged).
5.5. Termination form: The Buyer can exercise their right to terminate the contract by filling out the official document available at the following link: Form for unilateral termination of contract.
5.6. The Seller will confirm receipt of the termination notice to the Buyer via email without delay.
6. COMPLAINT PROCEDURE AND EXCLUSION OF WARRANTY
6.1. Responsibility for defects: The Seller is responsible for material defects of the products (silver, gold, and workmanship) that existed at the time of the transfer of risk to the Buyer, in accordance with the provisions of the Law on Obligations.
6.2. Exclusion of warranty: The warranty does not apply to damage caused by:
Mechanical means (breaking of chains, crushing of rings, impacts).
Inadequate storage and exposure to chemicals (perfumes, chlorine, humidity).
Normal wear and tear during use (natural wearing of the gold plating layer, minor scratches).

6.3. Damage in transit: The Buyer is obliged to inspect the shipment immediately upon receipt. If visible damage to the package or the product itself occurred during transport, the Buyer is obliged to immediately report it to the delivery person and, if possible, draw up a report on the damage.
6.4. Complaint procedure: In case of a justified complaint (material defect of material or workmanship), the Buyer is obliged to notify the Seller via email webshop@klara-jewelry.com. The Seller will, at its own expense, remedy the defect, replace the product, or refund the funds within the legal period.
7. COMPLAINTS AND DISPUTE RESOLUTION
7.1. Filing a complaint: The Buyer has the right to submit a written complaint about the service provided or the product purchased via email address: webshop@klara-jewelry.com or by mail to the Seller's registered office address.
7.2. Response deadline: The Seller undertakes to confirm receipt of the complaint and to respond to it in writing within 15 days from the date of receipt of the complaint.
7.3. Out-of-court dispute resolution: In case of a dispute, the Buyer and the Seller will endeavor to resolve it amicably. If this is not possible, the Buyer has the right to initiate a consumer dispute resolution procedure via the European Online Dispute Resolution platform (ODR platform) at the link: https://ec.europa.eu/consumers/odr.
7.4. Jurisdiction: For all disputes not resolved amicably or through the ODR platform, the competent court is according to the Buyer's domicile within the EU, or the court at the Seller's registered office for other cases, in accordance with the laws of the Republic of Croatia.
8. LIABILITY AND WEBSITE USAGE
8.1. Limitation of liability: The Seller makes maximum efforts to ensure that the content of the Web shop is accurate and up-to-date, but is not responsible for accidental damages caused by the use of the website or unintentional errors in the content.
8.2. Technical equipment: The Seller is not responsible for operational errors, internet connection interruptions, or any damage to the Buyer's computer equipment caused during the use of the Web shop.
8.3. Legal use: It is forbidden to use this website for illegal purposes, transfer of malicious software, or any form of system abuse.
8.4. Account termination: The Seller reserves the right to immediately terminate the Buyer's user account or disable access to the site in case of any behavior deemed to be non-compliance with these General Terms and Conditions or an attempt at fraud.
